Full clarification and definitions for specific terms (“commission,” “pre-made design,” “blacklist,” etc.) can be found at the bottom of this page.If these Terms of Service are flagrantly broken, you may be declined any future service and may be placed on a public Blacklist.These terms of service are applied universally to all artwork that I create for a transaction.By commissioning me, you agree to and acknowledge the entirety of these Terms of Service, including the following:
- That you fully understand what you are ordering
- That you know this is a completely digital product
- That I will not begin your commission until I'm paid in full, unless a payment plan is agreed upon beforehand (see “Payment” section)
- That you understand that these terms do not exclusively apply to artwork paid for in USD, they apply to all artwork I create for others, including Pre-Made Designs
- That I reserve the right to deny or cancel commissions for any reason (see “Refunds” section)
- Breaking any of these Terms of Service may result in being declined future service and being Blacklisted- - -Usage:
1. I retain all rights to my created artwork, meaning I may use it in ways including but not limited to self promotion or uploading it to any of my personal galleries/portfolios.2. If you do not want me to post your commissioned artwork publicly, consult with me at the time of ordering.3. Conversely, I hold no obligation to upload to a public gallery or otherwise promote the piece you have commissioned from me (e.g. if the artwork you commissioned comes with commercial usage rights for you, and you sell products featuring the artwork you commissioned, I have no obligation to post the commissioned artwork or any of its resulting products on my own socials)4. You may not use your commissioned artwork for commercial purposes without express permission. Using my work for commercial usage may come with a fee. Consult with me if you would like to commission work for commercial usage or purchase commercial usage rights for an existing design or commission.5. You may repost your finished commission so long as it has visible credit to me in the image and or description of the post (e.g. my signature is visible on the artwork and one of my social media handles is tagged in the description)6. Do not alter my signature on your commission.7. Do not edit your commission without permission. Minor edits that do not affect the integrity of the piece such as cropping, resizing, or adding a border (e.g. a name on top of the image, a pride flag, etc.) are acceptable without permission from me. Edits that are not allowed without permission include but are not limited to: draw overs, filters, color edits, etc.
- I am more than happy to make edits to your commission after it is fully complete, though it may come with a fee depending on the edit. Just ask!8. You may not heavily reference, trace, or copy your commission or custom design even if you are the one who commissioned it from me or are the owner of the design.9. You may not add your commissioned artwork into an A.I. Dataset or otherwise use it to assist in creating A.I. art pieces.10. You may not turn your commissioned artwork into a Non-Fungible Token (NFT).11. You may make or commission physical items (t-shirts, keychains, stickers, etc.) with your commissioned artwork or character design for personal usage only. These must be made in small quantities (10 or under) and may not be sold to others.- - -Custom Designs & Ownership:
1. My designs may be used in most personal capacities, with one exception being A.I. usage (“Usage 9.”). Consult with me if you'd like to use your design or artwork for commercial purposes.2. You may edit or redesign my designs in any way, as long as I am still credited as the original designer. The original artwork provided to you of the design may not be edited without permission, as outlined in “Usage 7.”3. I am very tentative on creating IP inspired designs. I will only create an IP inspired design if I am familiar with the IP. I intentionally try to make my IP inspired designs look significantly different than the IP it’s inspired by, and I will refuse some custom design edit requests if I think it will make it look too similar to the IP it’s based on. Please know that if you want a 1:1 or extremely similar design, I am not the person to commission!4. You may trade, sell, or gift my designs freely, with two exceptions:
- Do not scalp my designs for profit. Price increases based on the amount of artwork the character has gained since its last resale is completely acceptable and expected. Blatantly purchasing, increasing the price, and then reselling my designs for significant profit will cause you to be blacklisted.
- Do not trade my character designs to a blacklisted user. You will not be blacklisted for trading a character design to a blacklisted user unless it is suspected to be intentional blacklist evasion.- - -Payment:
1. All money payments will be made in USD (US Dollars) via Paypal unless otherwise stated or agreed upon prior to ordering.2. I don’t do holds for adoptables.3. Quoted pricing will be honored for up to 2 months after quoted. After the 2 months is up, if my prices have been raised after receiving your quote, your quote may be raised to reflect my pricing changes.4. In any circumstance, if you fail to pay what you owe for a pre-made design, the design will be put back up for sale. You may be blacklisted depending on the circumstances.5. You may not use your commissioned art or design in any capacity if you chargeback me. You will be placed on my blacklist.- - -Payment Plans:
1. Payment plans are allowed if the payment exceeds 200 USD. A non-refundable minimum down-payment of 100 USD is required up-front. Future payments must be made on, at a minimum, a once per month basis. The monthly payment must be a minimum of 100 USD, unless the remainder of what you owe is less than 100, in which case, the minimum will be the remaining amount that you owe.2. If a payment plan is enacted for a custom design or an art piece that is not pre-made, I will not progress past the sketch phase until I am paid in full. Any sketch provided to you before receiving full payment will have some, if not all, of these protective measures applied to it:
Thumbnail sized, low resolution, heavily watermarked, filtered, distorted, and applied with Glaze and Nightshade. A full-sized sketch will be sent after I have received full payment.3. If you fail to make the minimum payments on a pre-made design, your hold on the design will be revoked and it will be placed back up for sale.4. If you fail to make the minimum payments on a custom design or art piece, the commission will be canceled.- - -Refunds/Cancellation:
1. If for any reason I cancel your commission or I cannot finish your commission, you will be appropriately refunded.2. Nearly finished or completed pieces will not be refunded.3. If your commission is canceled either by you or I, any W.I.P. (Work in progress) images for either character designs or artwork commissions sent to you may not be kept or used in the future. Consult with me if you’d like a price or a deal to keep or use the W.I.P.(s) I’ve provided you.4. All sales are final.- - -Process:
1. I will send you the sketch of your commission before I begin the lining phase. I can implement any desired changes at this time. I can send additional W.I.P.s upon request. By default, I send updates whenever requested to make sure you are satisfied with the commission.2. All my commissioners are added to my Trello where you can check my progress at any time.3. Because of this constant communication to ensure your satisfaction, I will not remake a commission for any reason.- - -Definitions:For the purposes of these Terms of Service:
“Commission,” “Your Commission,” and “Your Commissioned Artwork,” refers to any artwork that I create for or at the request of another party, regardless of the payment method or currency used. Including but not limited to, monetary transactions, trade, barter, gifts, or any other form of exchange. Commissions encompass all custom artworks, illustrations, designs, or any other art services requested by the client.“Pre-made Design,” and “Adoptable,” refer to a character design that is created without design input from a customer, then put up for sale as-is after it is created.“Custom Design” refers to a character design that is created specifically at the request of a customer and is designed with their guidance and preferences.“Blacklist” refers to a public list of users who have flagrantly broken these Terms of Service and will be denied service indefinitely.- - -If you have any questions, feel free to ask!
